These Terms and Conditions ("Terms") govern your use of the Swara mobile application, website, and any related features, content, and services (collectively, the "Service") operated by Swara Learning Labs Pvt. Ltd., a company incorporated under the laws of [Country] ("we," "us," or "our").

Please read these Terms carefully before using our Service. By accessing or using Swara, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Your use of Swara may also be subject to the terms and policies of the app store from which you downloaded the app (such as the Apple App Store or Google Play Store). In the event of a conflict, the app store’s terms may apply in relation to that app store.

1. Acceptance of Terms

By downloading, installing, accessing, or using Swara, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are a parent or guardian allowing your child to use Swara, you agree to these Terms on behalf of your child and are responsible for their compliance with these Terms.

2. Eligibility

Swara is a kids-focused educational service intended for children under 13 and their parents or guardians. The Service may only be used:

• By children under 13 with the supervision and consent of a parent or legal guardian
• By parents or guardians on behalf of their children

If you are a parent or guardian creating an account, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to consent on behalf of your child.

Swara is not intended for users age 13 or older except as parents or guardians using the Service on behalf of a child.

3. Account Registration

3.1 Account Creation

• Parents or guardians may create and manage accounts for their children
• Parents or guardians must supervise account creation for children under 13
• A parent or legal guardian must provide consent where required by law before a child uses the Service
• You are responsible for maintaining the confidentiality of your account credentials

3.2 User Information

• During registration, we collect minimal information such as a nickname and age range
• We do not collect real names, dates of birth, or other personally identifiable information from children
• You agree to provide accurate information and to update it as necessary

We reserve the right to suspend or terminate accounts where information is inaccurate, incomplete, or misleading.

A parent or guardian may create and manage multiple child profiles under a single parent account where that feature is available.

4. Parental Controls and Supervision

4.1 Parental Gateway

• Swara includes parental control features that protect access to settings and certain features
• Parents or guardians must set up and maintain parental controls
• We are not responsible for unauthorized access if parental controls are not properly configured

4.2 Parental Responsibility

• Parents and guardians are responsible for supervising their children's use of Swara
• Parents should review and understand the content and features available in Swara
• Parents may contact us at any time to review, modify, or delete their child's information

While we design Swara with children’s safety in mind, we cannot replace active parental supervision.

Instructions on how to access, review, or delete your child’s information are set out in our Privacy Policy or may be requested at hello@swara.fun.

5. Use of Service

5.1 Permitted Use

You may use Swara for:

• Educational and learning purposes
• Personal, non-commercial use
• Age-appropriate content consumption

Any use of Swara for commercial purposes or to provide services to third parties is strictly prohibited.

5.2 Prohibited Activities

You agree NOT to:

• Use Swara for any illegal or unauthorized purpose
• Attempt to bypass or disable parental controls or security features
• Interfere with or disrupt the Service or servers
• Transmit any viruses, malware, or harmful code
• Copy, modify, or create derivative works of Swara
• Reverse engineer or attempt to extract source code
• Use automated systems to access Swara without permission
• Share your account credentials with others
• Impersonate any person or entity

We reserve the right to investigate and take appropriate action (including account suspension or termination) if we suspect any violation of these Terms or unlawful activity.

6. Content and Intellectual Property

6.1 Our Content

• All content, features, and functionality of Swara are owned by us or our licensors
• This includes but is not limited to: text, graphics, logos, images, audio, video, software, and code
• Swara is protected by copyright, trademark, and other intellectual property laws

All trademarks, logos, and service marks displayed on Swara are our property or the property of third parties. You are not permitted to use these without prior written consent.

6.2 Limited License

• We grant you a limited, non-exclusive, non-transferable, revocable license to use Swara
• This license is for personal, non-commercial use only
• You may not redistribute, sell, or sublicense Swara

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect information, especially information from children.

Depending on where you live, additional privacy rights may apply under local laws (such as the General Data Protection Regulation (GDPR) and its child-specific provisions). Our Privacy Policy explains how we address these rights.

We may use trusted third-party service providers (such as hosting or crash reporting services) to help us operate and improve Swara. These providers are bound by contractual obligations to protect your information.

8. Age-Appropriate Content

• Swara is designed to provide age-appropriate educational content
• All users see the same set of lessons and activities
• We strive to ensure all content is suitable for children, but parents should review content with their children

Swara does not display third-party advertisements.

9. No Social Features

• Swara does not include public profiles or direct messaging between users
• Children cannot post public content or share free-text personal information through the Service

If we introduce any interactive features in the future, they will be designed with children’s safety in mind and will not allow free-text exchange of personal information between users.

10. Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue Swara at any time
• Update features, content, or functionality
• Release new versions or updates
• We are not obligated to provide support for older versions

We are not liable for any loss or corruption of data resulting from modifications, updates, or discontinuation of all or part of the Service.

To access all features and security updates, you may be required to use the latest version of the app.

11. Disclaimers

11.1 Service Availability

• Swara is provided "as is" and "as available"
• We do not guarantee uninterrupted, secure, or error-free operation
• We are not responsible for any technical issues, downtime, or service interruptions

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11.2 Educational Content

• While we strive to provide accurate educational content, we do not guarantee its accuracy or completeness
• Swara is a supplementary educational tool and should not replace formal education
• We are not responsible for educational outcomes or academic performance

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to use Swara (if any) in the 12 months preceding the claim
• Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you

Nothing in these Terms is intended to exclude or limit any rights you have under applicable consumer protection laws that cannot be lawfully excluded or limited.

13. Termination

13.1 By You

• You may stop using Swara at any time
• You may delete your account through the app settings (subject to parental controls)

13.2 By Us

We may terminate or suspend your access to Swara immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent, illegal, or harmful activity
• Fail to pay required fees (if applicable)
• We determine termination is necessary for legal or safety reasons
• Your account has been inactive for 6 months—inactive accounts will be deleted

Where reasonable and permitted by law, we will provide notice before termination or suspension. However, we may act without notice if we believe it is necessary for security, legal, or safety reasons.

Upon termination or deletion of your account, we will handle your and your child’s data as described in our Privacy Policy, including any retention periods required by law.

14. Changes to Terms

We may modify these Terms at any time. We will:

• Post the updated Terms on our website and in the app
• Update the "Last Updated" date
• For material changes, we may provide additional notice

Your continued use of Swara after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using Swara.

We may notify parents of material changes by email (if available) or via prominent notice within the app or website.

15. Children's Online Privacy Protection Act (COPPA)

Swara is designed for the Kids Category and complies with COPPA and other applicable children's privacy laws. For users in the European Union, United Kingdom, and similar jurisdictions, we comply with child-specific data protection requirements (such as GDPR and its child provisions), and where required we obtain verifiable parental consent before processing a child’s personal data. We:

• Collect minimal information from children (such as nickname, age range, avatar selection, and progress data)
• Do not collect contact information or sensitive identifiers from children without parental consent
• Provide parents with access to review and delete their child's information
• Do not share children's information with third parties except as described in our Privacy Policy
• Retain children’s data only for as long as necessary to provide the Service or as required by law, after which it is deleted or anonymized

16. Fees, Subscriptions, and In-App Purchases

Some features of Swara may require payment of fees. Where you purchase a subscription or in-app content, billing and payment processing are handled by the app store from which you downloaded the app and are subject to that store’s terms and refund policies. You can manage or cancel your subscription through your app store account settings.

17. Third-Party Services

Swara may include or rely on third-party services (such as hosting, analytics, or crash reporting tools). We are not responsible for the content, availability, or practices of these third parties, but we require them by contract to protect personal data in accordance with applicable law. 18. Security

We use reasonable technical and organizational measures to protect information collected through Swara. However, no system is completely secure, and we cannot guarantee absolute security. Please notify us immediately if you believe your account has been compromised.
